Terms and Conditions
The following terms of service (these “Terms of Service”) govern your access to and use of the Curveup mobile application, including any content, functionality, and services offered on or through Curveup mobile application (the “App” or “Platform”) by Curveup PVT LTD (108/10c Watarapola road Mount Lavinia ) are collectively referred hereto as ” (CurveUp App) “ “we” or “us”.
Please read the Terms of Service carefully before you start to use the app. By using the app, opening an account or by agreeing to accept or agree to the Terms of Service when this option is made available to you, you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy, found here, incorporated herein by reference. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the app. For more detailed policies surrounding the activity and usage on the app, please access the designated articles herein.
This app is offered and available to users who are 13 years of age or older. If you are under 13 you may not use this site or the app services. By using this app, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the app.

The original language of these Terms of Service, as well as all other texts throughout the app, is English. App makes available this translation for convenience only. In case of conflicts between the original English version and any translation, the English version shall prevail.
Key Terms
Customers are users who obtain/ purchase services on Curveup mobile application
Curveup mobile application Experts are users who register with Curveup mobile application as individual service providers.
Services are created by Sellers to offer video-based consultations to customers at a price and duration defined by the Seller.
Appointments are initiated by Customers and fulfilled by Sellers.
Disputes are disagreements experienced during an order between a customer and Seller on
Curveup mobile application Balance is the aggregated amount of your Revenue as a Seller.
Payment Services Provider(s) are service providers that provide payment services to customers and sellers in connection with the Curveup mobile application platform, including with respect to the collection of funds from customers in connection with purchases, remittance and withdrawal of funds to Sellers, currency exchange services in connection with payments in local currencies, and the holding of funds in connection with Curveup mobile application Balances.
Revenue is the money that Sellers earn from completed Appointments, subject to the terms and conditions.
Sellers
Sellers create the business page and Services.
Sellers define the price and the duration of the Services.
Curveup mobile application Organization Owners assign Organization Experts to Services they are eligible to provide.
Each Service Sellers successfully complete accredits your Curveup mobile application Revenue with net revenue with agreed percentage of the consultation amount.
Revenues are only made available for Sellers on a weekly basis for services completed successfully in the respective week.
Sellers will be paid weekly directly to their bank accounts.
For security concerns, Curveup mobile application temporarily disable a Seller’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues or improper behavior reported by customers.
Sellers are responsible for paying any direct or indirect taxes, including any GST, VAT, or otherwise, which may apply to them depending on residency or location. Sellers represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction. The price shown on the Service is inclusive of all such taxes and charges that may apply to the Sellers.
Appointment as Limited Payment Collection Agent: Seller hereby appoints Curveup mobile application as Seller’s limited authorized payment collection agent solely for the purpose of accepting payments (or its Payment Services Provider, as applicable) from Customer, and remitting those payments to Seller. Seller agrees that payment from Customer to Curveup mobile application shall be considered the same as a payment made directly to Seller. Customer’s payment obligation to Seller will be satisfied upon receipt of payment by Curveup mobile application (or its Payment Services Provider, as applicable), and Curveup mobile application via its Payment Services Provider, as applicable) is responsible for remitting the funds to the Seller in the manner described in these Terms of Service. In the event that Curveup mobile application (via Payment Services Provider) does not remit any such amounts to Seller, the Seller will have recourse only against Curveup mobile application and not the Buyer directly. Seller agrees that Curveup mobile application may describe or otherwise reflect the terms contained herein in any terms of service, receipts, disclosures, or notices including, but not limited to, receipts provided to Customers that Curveup mobile application may deem necessary or prudent.
Curveup mobile application partners with Payment Service Providers for purposes of collecting payments from Customers, transferring such payments from Customers to Sellers, and holding funds in connection with Curveup mobile application Balances. All payments services in connection with the withdrawal of funds on the Curveup mobile application platform are performed by Curveup mobile application Payment Service Providers.
Sellers are responsible for obtaining a general liability insurance policy with coverage amounts that are sufficient to cover all risks associated with the performance of their services.
Business Profile
Sellers are required to create a business profile and select the business category which the intended services fall under.
Sellers will be required to provide information, certifications & education that qualifies you to provide services in the selected business category.
Once a profile created with supporting documents, the business profile will undergo a verification process. Until the business profile is approved you will see your profile as not verified. Once the business profile is approved, it will be published to the public on the Curveup mobile application.
Sellers are only allowed to create services for business profiles verified by Curveup mobile application We will be conducting random checks to ensure the services listed are relevant to the business category and Curveup mobile application may temporarily disable the business profile in event of irreverent services found under a business profile category or if the seller is found conducting a fraudulent or illicit activity. This may come as a result of security issues or improper behavior reported by customers.
Services
Sellers are allowed to create services under the business profile, only if the business profile is approved.
Sellers are allowed to create services under their Company Profile which is allowed for the selected business category.
The seller can upload an image or a short video related to the service.
The seller should provide clear content that is easy for the Customer to apprehend.
The seller is required to provide the cost per video consultation while creating a service.
Curveup mobile application has the right to charge a platform fee which is a percentage of the revenue, which will be deducted only when you make a revenue.
Termination Clause
These Terms of Use shall remain in full force and effect while you use the Application. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SITE OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.
If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
